TERMS AND CONDITIONS

SHARED RESPONSIBILITIES MODEL

CreativaShift’s Obligations

Service Delivery:

• Continuous updating of content and methodologies.
• Specialized technical support during business hours.
• Data protection in accordance with international standards.

Quality and Professionalism:

• Services provided by qualified consultants and specialists.
• Methodologies based on industry standards and best practices.
• Confidentiality of the information provided by the Client.
• Delivery of services and deliverables according to the timelines established for each project.

Deliverables and Delivery Times

All services marketed by CreativaShift, operated by NUVOX PUBLICIDAD S.A. DE C.V., are delivered 100% digitally through email, download links, online platforms, collaborative workspaces, or any other electronic means that the company determines appropriate for the proper provision of the service.

Unless a different timeframe is established in a commercial proposal, specific agreement, or quotation, projects will have an estimated delivery time of 3 (three) to 15 (fifteen) business days, beginning once:

• The Client has made the corresponding payment, when applicable.
• All information, documentation, access credentials, and materials necessary for the execution of the project have been received.
• The scope of the service has been confirmed by both parties.

The Client acknowledges and agrees that the delivery time may vary depending on the complexity, scope, workload, requested revisions, or additional requirements of the project. If it is necessary to extend the initially estimated timeframe, NUVOX PUBLICIDAD S.A. DE C.V. will notify the Client in a timely manner.

Requests for modifications, changes in scope, or late delivery of information by the Client may result in a rescheduling of delivery times without this constituting a breach by NUVOX PUBLICIDAD S.A. DE C.V.

We would also recommend adding a brief clause at the end of the “Business Services Ecosystem” section, as it strengthens the policy:

Nature of the Deliverables

All services offered by CreativaShift consist of professional consulting, strategy, design, development, and organizational transformation services. Unless expressly stated otherwise in the applicable quotation or agreement, deliverables will be provided exclusively in digital format and do not include the delivery of printed, physical, or in-person materials.

With these additions, the policy is more robust from a contractual perspective, clearly establishing:

• that all deliveries are digital;
• that the general timeframe is 3 to 15 business days;
• that the timeframe depends on the complexity of the project;
• that the timeline begins once the Client provides all necessary information; and
• that changes requested by the Client may modify the delivery schedule.
